37. ( 1 ) T h e m i n o r u n d e r s i x t e e n y e a r s o f a g e s h a l l a l s o b e exempt from criminal responsibility for any act or omission don e without any mischievous discretion. (2) In the case where the act or omission is committed by a minor who is aged between fourteen to sixteen years of age with mischievous discretion and in the case where the minor is aged between sixteen and eighteen year s, the applicable penalty shal l be decreased by one or two degrees.
