Criminal Code (Cap. 9), article 48A

48A. (1) Whosoever in Malta conspires with one or more persons in Malta or outside Malta for the purpose of committing any crime in Malta liable to the punishment of imprisonment sha ll be guilty of the offence of con spiracy to commit that offence. (2) The conspiracy referred to in sub-article (1) shall subsist from the moment in which any mode of action whatsoever is 36 CAP. 9.] CRIMINAL CODE planned or agreed upon between such persons. (3) Any person found guilty of conspiracy under this article shall be liable to the punishment for the completed offence obj ect of the conspiracy with a decr ease of two or three degrees. (4) For the purposes of sub-article (3), in the determination of the punishment for the completed offence object of the conspira cy account shall be had of any circumstances aggravating that offe nce.
