693. (1) The period of prescription is interrupted by any act of the proceedings served on the par ty charged or accused in respe ct of the fact with whi ch he is charged. (2) The period of prescription is also interrupted by the warran t of arrest or, where there are no grounds for the arrest, by the summons, although the warrant of arrest or the summons shall ha ve had no effect on account of the f act that the party charged or accused had absconded or left Malta. (3) Where the period of prescription has been interrupted, it shall recommence to run from the day of the interruption. (4) The interruption of prescription shall operate in regard to all persons who took part in the offence, even though the act o f interruption takes place ag ainst one person only. 416 CAP . 9.] CRIMINAL CODE Application of prescription ex officio.
