Criminal Code (Cap. 9), article 93
93. (1) Whosoever reviles or threatens a judge, or the
Attorney General, or a magistrat e or a juror, while in the exer cise
of his functions or because of hi s having exercised his functio ns, or
with intent to intimidate or unlawfully influence him in the ex ercise
of his functions, shall, on conviction, be liable to imprisonme nt for
a term from nine to eighteen months and to a fine ( multa ) of not
less than five hundred euro (€500) and not more than one thousa nd
five hundred euro (€1,500).
Aggravating
circumstance.
(2) If the object of the vilifi cation is that of damaging or
diminishing the reputation of the person against whom it is
directed, the punishment shall be imprisonment for a term from
twelve months to two years and to a fine ( multa ) of not less than
seven hundred euro (€700) and not more than two thousand and
five hundred euro (€2,500).
(3) Where the threat is of a crime, the punishment shall be
imprisonment for a term from eighteen months to three years and to
a fine ( multa ) of not less than one thousand five hundred euro
(€1,500) and not more than four thousand euro (€4,000), and if the
threat be made by means of any writing, whether anonymous or
signed in one’s own name or in a fictitious name, the punishmen t
shall be increased by one degree, and in either case, the offen der
may be required to enter into a recognizance as provided in art icles
383, 384 and 385, with or without surety, according to
circumstances.
(4) Where the offences referred to in this article are committed
against an officer of the Attorney General’s office, when actin g
under the direction of the Attorney General in anything in whic h
the Attorney General is to act i n his own individual judgement or in
connection with his office, the offender shall be liable to the same
punishment established in the preceding sub-articles.
