279. T h e n u l l i t y o f a n y w a r r a n t o r o r d e r o r o f t h e e x e c u t i o n thereof shall entitle the party against whom the warrant or ord er is issued to an action for damages and interest against the person suing out execution if the nullity arises out of any act of suc h person, or against the court executing officer who executed the warrant or order if the nullity ar ises out of any act of the co urt executing officer.
