613. Where it is made to appear to the satisfaction of any of the superior courts, or of the Court of Magistrates (Gozo) in its superior jurisdiction, that the evidence of any person who is a bsent from Malta is indispensable for the determination of any cause pending before any of such courts, it shall be lawful for the c ourt to make an order declaring the examination of such witness to be necessary and the court may stay the proceedings after having complied with the provisions of article 158 and adjourn the cau se to a time within which such evidence is to be obtained.
