794. (1) The plea of lis alibi pendens or of connection of actions may be raised at any time until judgment is delivered. (2) The court shall determine the plea; and if such plea is disallowed, the court may at the same time decide on the merits of the action. Cap. 234. (3) Where an application to the C ivil Court, First Hall has been made under article 355 of the Merchant Shipping Act , the foregoing provisions of this article shall apply only to the ex tent that they are not inconsistent with the provisions of that arti cle.
