46. During the pendency of the action for separation, either spouse, whether plaintiff or defendant, may leave the matrimoni al home and may, whether or not he or she has left the matrimonial home demand that the court shall determine who of the spouses i f any shall reside in the matrimonial home during the pendency of such action. 22 [CAP. 16.
