Civil Code (Cap. 16), article 518
518. (1) A sale by licitation which takes place with the consent
of all the co-owners, is not subj ect to any formality, and may be
made by means of any person and in whatsoever manner the co-
owners may agree upon; but in any such case there is no sale un til
the highest bid has been accepte d and, if the licitation is in respect
of immovable property, until a contract is made by means of a
public deed.
(2) The same rule shall apply where, although the sale by
licitation has been ordered by a judgment, the p arties agree to carry
it out in a manner other than tha t established for judicial sal es by
auction.
