Civil Code (Cap. 16), article 754
754. Where in the substitution clause only one of the two
contingencies is stated, that is , either that the institute sho uld be
unable, or that he should be unwilling to receive the inheritan ce or
legacy, the other contingency shall, unless the disponer shall have
stated the contrary, be deemed to be included.
