60. A demand as provided in article 58 may also be made by a perso n who has been arrested but not charged. In such a case the appli cation referred to in article 59 may on ly be allowed after the Police have been given an opportunity to reply to the application which shall be served upon the Police for the purpose. The application shall not be allowed if it is opposed by the Police and the period of prescription for the exercise of the criminal action in respect of the offence for which the applicant was arrested has not lapsed.
