92. (1) A person shall be dis qualified fr om receiving - (a) Sickness and Injury Benefits for any period during which he is absent from Malta unless - (i) he is absent in the course of employment of the kind described in paragraph 2 of Part I of the First Schedule to this Act; or (ii) he proves to the satisfaction of the Director that his absence from Malta was in connection with his own medical treatment abroad in respect of that sickness or injury or industrial disease which has caused his claim for benefit; (b) Sickness Assistance, Leprosy Assistance, or Tuberculosis Assistance during any period in which the person in respect of whom such assistance is being paid is absent from Malta unless he proves to the satisfaction of the Director that his absence from Malta was in connection with his own medical treatment abroad for that condition or disease in respect of which such assistance is being paid. (2) Entitlement to Social Assistance or to an Age Pension payable under this Act shall not be extinguished in respect of any member of the household who is abroad provided the head of such household proves to the satisfaction of the Director that such visit abroad is in connection with the medical treatment of such pers on; sohowever that the right for suc h assistance shall be extinguis hed after the lapse of six months st arting from the first day of th e person’s absence from Malta for s uch treatment except where suc h visit abroad was approved by Government. (3) With effect from the 1st January 2016 entitlement to Social Assistance or to an Age Pension payable under this Act shall no t be extinguished: (i) when a person proves to the satisfaction of the Director that he or she shall be abroad in a European country for a period not exceeding eight days in a calendar year; (ii) when a person proves to the satisfaction of the Director that he or she shall be abroad in a Non- European country for a p eriod not exceeding one month in a calendar year. (4) With effect from the 1st January 2016 entitlement to an Age Pension payable under this Act shall not be extinguished where a person proves to the satisfaction of the Director that he or sh e shall be abroad in Australia, Canada or New Zealand for a period not exceeding three months in a calendar year. 96 CAP. 318.] SOCIAL SECURITY Residents of state financed residential service.
