13A. (1) Whenever a subject person feels aggrieved by an administrative penalty imposed by the Unit in terms of rules an d regulations made under article 13 , and that administrative pena lty exceeds five thousand euro (€5,00 0), whether imposed in respect of one or more contraventions, the subject person may appeal such administrative penalty both on points of law and fact. Cap. 12. (2) The appeal as referred to in sub-article (1) shall lie to t he Court of Appeal (Inferior Jurisdiction) constituted in terms of article 41(9) of the Code of Organization and Civil Procedure . Cap. 12. (3) An appeal to the Court of Appeal (Inferior Jurisdiction) in terms of sub-article (1) shall be filed in the registry of the said Court within twenty days from the date when the imposition of t he administrative penalty is notified to the subject person, and, saving the provisions of this article, such an appeal shall be regulat ed by the applicable provisions of the Code of Organization and Civil Procedure relating to appeals. (4) The Court of Appeal (Inferior Jurisdiction) shall, without delay, set down the appeal for hearing at an early date, which date shall in no case be later than three (3) months from the date o f the filing of the appeal. (5) The Court of Appeal (Inferi or Jurisdiction) shall hear the appeal which shall be decided within six (6) months from the da te fixed for the original hearing of the appeal, and no adjournment beyo nd the said six (6) months shall be granted except either with the consent of the appellant and the respondent or for an exceptional reason to be recorded by the court, and such adjourned date shall not be later than that justified by any such reason. (6) For the purposes of safeguarding the confidentiality of information and documents relating to the proceedings, the appe al before the Court of Appeal (Inferior Jurisdiction) filed in ter ms of this article shall be heard in camera and saving the provisions of article 13C the judgment shall not be published.
