78. (1) The seller shall be liable to the consumer for any lack of conformity which exists at the time when the goods were deli vered and which becomes apparent within two years of that time. Witho ut prejudice to article 73(4), this sub-article shall also apply t o goods with digital elements: Provided that in the case of goods with digital elements, where the sales contract provides for a continuous supply of th e digital content or digital service over a period of time, the seller sh all also be liable for any lack of conformity of the digital content or dig ital service that occurs or becomes ap parent within two years of the time when the goods with digital elem ents were delivered. Where the contract provides for a continuous supply for more than two yea rs, the seller shall be liable for any lack of conformity of the digita l content or digital service that occurs or becomes apparent within the peri od of time during which the digital content or digital service is to be supplied under the sales contract. (2) The two-year period mentioned in sub-article (1) shall be suspended for the duration of ne gotiations carried on between t he seller and the consumer with a v iew to an amicable settlement. 62 CAP. 378.] CONSUMER AFF AIRS Termination of the sales contract.
