39. (1) Subject to other provisions of this Act, all laws, rules, regulations, orders, judgments, decrees, awards, deeds, bonds, contracts, agreements, instrumen ts, documents, warrants and oth er arrangements, subsisti ng immediately before the date of the com ing into force of this Part of this A ct affecting or relating to an y of the properties or undertakings transferred to the Authority by or u nder this Act and in which the Government or a government authority is a party thereto or is named therein shall have full force and e ffect against or in favour of the Authority, and shall be enforceable freely and effectively, in such manner as if instead of the Government or governmental authority the Authority has been named therein or had been a party thereto in substitution of th e Government or governmental authority in question. Cap. 423. (2) Subject to the other provisions of this Act, all laws, rule s, regulations, orders, judgments, decrees, awards, deeds, bonds, contracts, agreements, instrumen ts, documents, warrants and oth er arrangements, existing immediately before the date of coming in to force of this sub-article affecting or relating to any of the p roperties or undertakings transferred to the A uthority by, or under this Act in relation to the Malta Resources Authority Act and in which the Government or a government authority is a party thereto or is n amed therein shall have force and effect against or in favour of the Authority, and shall be enforceable freely and effectively, as if the Auth ority has been named therein or had been a party thereto instead of the Government or governmental authority in question.'
