59. (1) Any person, including a department of government or a body corporate established by law, wishing to carry out any activity referred to in article 58, not being an activity for w hich an authorisation is given in an order and to be carried out in accordance with the provisions the reof, shall apply to the Auth ority for such authorisation, in such manner, on such form and giving such information including environmental assessments and studie s, as the Authority may prescribe. ENVIRONMENT PROTECTION [CAP. 549. 43 (2) Any person may also submit a written request to the Authority for a determination as to whether a proposal requires an authorisation, environmental assessment or other relevant submission. (3) Any person may declare an int erest in those applications for authorisations falling under this article and which the Ministe r, by virtue of regulations, identifies for this purpose and, on the basis of issues relevant to the environme nt, make representations on suc h application. The said declaratio n of interest and the represent ations shall be in writing and are to be received by the Board of the Authority within such period as established by regulations prescribed by the Minister. A declaration that is not submitted within this stipu lated period shall be considered null and may not be considered by th e Board of the Authority. (4) During the processing of the application, the Board of the Authority shall consider representations made by registered int erested parties in accordance with the provisions of sub-article (3). (5) The Board of the Authority shall inform the registered interested parties of the Board of the Authority’s sitting when such application shall be discussed: Provided that such represen tations may be made in any format deemed appropriate by the Board of the Authority, and sh all include representations received by post or by hand and those submitted electronically: Provided further that if the last day for submissions of representations as set out by th e Board of the Authority is a p ublic holiday or a day when the offices of the Authority are closed t o the public, the time limit for such submissions shall be deemed to expire the next following working day.
