218. (1) A grievous bodily harm is punishable with imprisonment for a term from five to ten years - (a) if it causes any permanent debility of the health or any permanent functional debility of any organ of the body, or any permanent defect in any part of the physical structure of the body, or any permanent mental infirmity; (b) if it causes any serious and permanent disfigurement of the face, neck, or either of the hands of the person injured; (c) if, being committed on a woman with child, it causes miscarriage. (2) Any debility of the health or any functional debility of any organ of the body, and any mental infirmity, serious disfigurem ent, or defect shall be deemed to be p ermanent even when it is proba bly so. (3) The punishment for the offe nces referred to in sub-article (1) shall be that established in article 312(2) if the bodily h arm is committed by means of any e xplosive fluid or substance. Decrease of punishment in case of supervening accidental cause. Amended by: V .1868.10; XI.1900.32.
