Criminal Code (Cap. 9), article 249
249. (1) Whosoever by means of any writing, whether
anonymous or signed in his own or in a fictitious name, shall
threaten the commission of any crime whatsoever, shall, on
conviction, be liable to imprisonment for a term from six to tw elve
months or to a fine ( multa) not exceeding five t housand euro (€5,000),
or to both such imprisonment and fine:
Provided that where the thr eat concerns the use of nuclear
material to cause death or serious injury to any person or
substantial damage to property or the commission of an offence of
theft of nuclear material in order to compel a natural or legal
person, international organization or State to do or to refrain from
doing any act the punishment for the offence shall be increased by
three degrees; the expression "nu clear material" shall have the
same meaning assigned to it by article 314B(4).
( 2 ) W h e r e t h e t h r e a t , b e i t e v e n v e r b a l , c o n t a i n s a n o r d e r , o r
imposes a condition, the offende r shall, on conviction, be liab le to
the punishment prescribed in sub-article (1), provided that suc h fine
(multa) shall not exceed ten thousand euro (€10,000).
(3) Moreover the offender shall be required to find a surety, or
to enter into a recognizance as provided in articles 383, 384 a nd
385.
