288. The offender shall be liable to the punishments established for contraventions, when, in any case of simple theft, the gain contemplated by the offender is the mere use of the thing, with intent to restore the same immediately. GENERAL PROVISION APPLICABLE TO THIS SUB-TITLE Punishment in case of second or subsequent conviction for theft.
