402A. Where in respect of a person charged before the Courts of Magistrates as a court of criminal inquiry a court has made an order for his temporary surrender to a foreign State requesting his extradition or to any other fore ign competent authority request ing his surrender, the terms referre d to in article 402(1) shall, f rom the date of his return to Ma lta, recommence to run anew. When court is of opinion that offence is triable by the Court of Magistrates as court of criminal judicature. Added by: XI.1900.76.
