Criminal Code (Cap. 9), article 534
534. (1) In the case of an offence against the regulations
relating to motorcars or against any law or regulation relating to the
traffic of vehicles, the costs m ay, in the event of the declara tion
referred to in sub-article (3) o f the last preceding article, b e
recovered as a civil debt from the owner of the vehicle althoug h he
is not the person convicted:
Provided that where the person convicted is not the owner
of the vehicle, the liability of the latter for the costs shall not
exceed the value of the vehicle.

(2) Where the owner of the vehicle was not a party to the
proceedings, the court shall, on the application of the registr ar,
order the owner to appear and to show cause why he should not b e
condemned to pay the said costs; and the court shall order that the
costs be paid by the owner unless the latter shall prove, to th e
satisfaction of the court, that the vehicle was, at the time of the
offence, driven by or in the custody of the person guilty of th e
offence, without his knowledge or consent, whether express or
implied.

(3) For the purposes o f this article -
the expression "vehicle" has the same meaning as in article 2 o f
the Code of Police Laws ;
the expression "owner" means the person in whose name the
licence in respect of the vehicle has been issued.
