Criminal Code (Cap. 9), article 574
574. (1) Any person charged or accused who is in custody for
any crime or contraven tion may, on application or as provided i n
article 574A, be granted tempor ary release from custody, upon
giving sufficient security to a ppear at the proceedings at the
appointed time and place under such conditions as the court may
consider proper to impose in t he decree granting bail which dec ree
shall in each case be served on the person charged or accused:
Provided that the Minister responsible for justice may by
regulations provide for any systems of bail management whether
electronic or otherwise, and for procedures, formalities or mod alities
which are to apply in order to ensure that the person charged o r
accused abides by the conditions imposed upon him by the court when
release from custody on bail of the person charged or accused i s
granted subject to the condition that the person charged or acc used
attends at a place on specified da ys and times. Such regulation s may
also provide for the taking and use of fingerprints, and the pr ocessing
of any data derived from such fin gerprints by electronic means.

(2) It shall also be lawful for the President of Malta, in speci al
cases, to grant temporary releas e to any accused person who is in
custody for any crime or contravention, subject to such conditi ons
as the President of Malta may think fit to impose. In default o f
observance by the accused of any of such conditions he shall be
liable to be re-ar rested forthwith.
