81. There shall not be deemed t o be an unlawful assembly under the provisions of the preced ing articles, where three or more persons shall assemble for the common purpose of assisting in t he CRIMINAL CODE [CAP. 9. 53 defence of the possession of the dwelling-house or other proper ty of any one of them or in the defence of the person of any one o f them although they may execute or endeavour to execute such purpose, or otherwise conduct themselves violently and tumultuously, or in such manner and under such circumstances as are calculated to create terror and alarm among persons in Malt a.
