757. (1) In the actions referred to in the last two preceding articles, where it is not alleged that the lease was contracted for a determinate period, the value is determined by the amount of ea ch termly payment, if the lease is in respect of urban property, o r by the rent of one year, if the leas e is in respect of rural prope rty. or where a determinate period is alleged by defendant. (2) If the defendant alleges that the lease was contracted for a determinate period by reason of w hich the court declares the ma tter to be outside its jurisdiction, the provisions of article 754 s hall apply as regards the reservation of costs.
