Criminal Code (Cap. 9), article 442
442. Where the defence of the accused has been conducted by
the Advocate for Legal Aid, the allowances due to the witnesses
actually produced on behalf of the accused shall be paid by the
Government at the same rates fixed for witnesses for the
prosecution, provided the Advocate for Legal Aid shall affirm o n
oath that, in his opinion, the evidence of the said witnesses w as
relevant for the defence, and provided also that, in view of hi s
poverty, the accused has not the means of paying such allowance s.
